Terms and Conditions
Acceptance
All bookings accepted by McBains are subject to these Terms and Conditions that are deemed to have been accepted in full by the Guest, or the Organiser of a function or event. Payment of a deposit and Booking Fee also indicates acceptance of these Terms and Conditions.
Reservations & Payment
When a booking is made, 100% of the total booking fee is required immediately in advance to confirm the booking. The booking is only confirmed and finalised once we have received notice by email that 100 % of the booking fee has been paid.
Arrivals & Departures
Rooms and cabins are available for occupation after 14:00 on the day of arrival. Early access to rooms and cabins is possible by special prior arrangement and confirmed in writing by McBains. Rooms and cabins must be vacated and keys returned by 10:00 on the day of departure, unless otherwise indicated prior to or at arrival and confirmed in writing by McBains.
Cancellation Policy (Guests)
Less than 48 hours or non-arrival: 100% deposit/money paid is forfeit. Up to 7 days before arrival: 25 % of deposit/money paid is forfeit Up to 30 days before arrival: 50 % of deposit/money paid is forfeit. Up to 90 days before arrival: full refund Cancellations must be notified to us in writing. No verbal cancellations will be accepted. A change of arrival date or departure date by the Guest or Organiser may be treated as cancellation and re-booking. We will endeavour to credit you the forfeit amount as a voucher for a future stay at a time that is convenient to both parties.Minimum Stay
Our minimum length of stay is 1 night during the week, and 2 nights during weekends, over public holidays, during school holidays, high season and long weekends, with no maximum.
Full Take-over Bookings
The contact person, or Organiser, is the person making the booking and signing on behalf of the full take-over booking. This person is responsible for all the guests in their group. Our minimum length of stay is 1 night during the week, and 2 nights during weekends, over public holidays, during school holidays, high season and long weekends, with no maximum. The full take-over rate includes accommodation for up to 40 people, as well as not more than 40 people on the property at any given time. Should you wish to arrange an event and require more than 40 people on the property, an additional per person rate is payable. Permission to host any additional persons on the property must be made in writing by the event Organiser and is at the discretion of McBains, and subject to prior written consent by McBains.
Damages and Breakages
Deposit an additional refundable breakages and damages deposit is payable for full take-over bookings, as well as any group booking of 10 guests or more. This will be refunded within 7 days of departure, less costs (if any) incurred to McBains due to breakages and damage caused by the group which amount to less than the deposit paid. The Organiser and their group will be required to pay for additional damages and breakages which exceed the damages and breakages deposit. In the event that breakages or damage are discovered, or extra cleaning required, after departure, we will notify the Guest in writing within 7 day of departure, providing detail of the issues and an invoice for the cost of rectifying them.
The Organiser
The Organiser is the teacher, facilitator or organiser of a retreat, event or camp. This person takes responsibility for their group and warrants that they have the necessary event and personal liability insurance.
Minors
Minors are the sole responsibility of the parent, guardian(s) or the person or persons in which care they are whilst at McBains or whilst using its facilities. In the event of a camp or function organised for or including minors, the event Organiser takes full responsibility for the minors attending the camp or function.
Lodging and Facilities
McBains reserves the right to alter room set-up and room allocation. Full take-over bookings guarantee exclusive use of all the rooms, the space and facilities. For smaller bookings, McBains reserves the right to host other guests on the property or to alter the lodging options at our discretion. For smaller bookings, facilities may be shared with other guests.
Valuables
McBains and the owners do not accept any liability for loss or damage to any valuables or property belonging to guests or their visitors. It is therefore the sole responsibility of all guests to make arrangements for adequate insurance coverage on all valuable items prior to arrival at McBains. This includes but is not limited to photographic equipment, laptop or other electronic devices, jewellery, cash, and vehicles.
Swimming and hiking
Any guests or their visitors who choose to engage in swimming or hiking in the area do so entirely at their own risk and they are fully aware that there are no life-saving facilities of any nature provided and therefore indemnify McBains and the owners of this facility in full and shall have no claim whatsoever nature against McBains and the owners including any claim for any injury / bodily harm / death and/or loss of property which could arise from participation in these activities. You require a permit from Cape Nature to access the river and mountain. McBains will not be held responsiblesinible for any safety or issue arising from accessing Cape Nature’s property or the Limietberg Nature Reserve.
Music and sound levels
All amplified music must be restricted to the inside of the premises. Under no circumstances may PA speakers be directed to or placed on the outside of the building (unless by prior arrangement with McBains). All music must be turned down by 23:00 and must be kept and at an acceptable volume that does not cause disruption or disturbance to the surrounding /neighbouring area.
Keys
Keys will be provided for the rooms and cabins and are to be returned upon departure. For any keys not returned, there will be a R100 charge. If the Guest loses or misplaces their keys during occupation and require assistance to gain entry, an additional charge of R50 will be made.
The Premises
The Premises shall at all times be under the control of the McBains owners who reserve the right to impose any terms and conditions in addition to those contained herein, as they may deem necessary, in order to ensure the rights of both staff and other visitors to McBains.
Pets
McBains is pet friendly, however no pets are allowed unless by prior arrangement and written consent from McBains. There is a once-off pet fee per pet which is payable with your booking fee. Additional charges will be incurred by the Guest if it is evident to the manager or cleaning staff that pets have damaged or dirtied the room or any contents thereof. It is the responsibility of the owner to clean up after their pet in the gardens. At all times animals must be kept under control and not be of disturbance to other guests or neighbours. Guests are required to bring all feeding bowls, bedding and food for their pets. Animals are not to be left at the property unattended. Any evidence contrary to this policy will see possible eviction and penalty fines.
Smoking
No smoking is allowed inside any of the rooms or buildings. Smoking is only allowed in designated smoking areas. Please be aware that McBains is located in a high risk fire area, and ensure that all cigarettes are disposed of thoughtfully and responsibly.
Fires and Braais
Fires and Braais may only be made in clearly designated fire places and braai places. All fires and braais may only be used by a responsible adult. All fires and braais are to be supervised at all times and may not be lit and then left unattended. It is the Guest and / or Organiser’s responsibility to ensure that all furniture, bags and children remain safely away from fires and hot ashes. All fires and braais must be extinguished by 22:00.
Water and Electricity
Guests are asked to please be mindful of water and electricity use. Please switch off most lights when not in a room and ensure that water is used conservatively.
Recycling and Refuse
Guests are asked to adhere to our recycling and refuse policy. Please consider what you bring all the way up the Pass with you, and help us by taking as much recycling away with you as possible.
Property Use
The Guest is responsible for taking all reasonable care of their room or cabin and its contents. Guests are asked to please leave their room or cabin and all equipment, utensils, furniture etc. reasonably clean and tidy at the end of their stay at McBains. No items, including and especially books, may be removed from the accommodation or any of the buildings. Except in the case of normal wear and tear the Guest will be responsible for making good any damage to the room or cabin or its contents which has occurred due to negligence, willful damage or irresponsible behaviour on the part of the Guest or their visitors. Such damage must be reported to us without delay. In the event that breakages or damage are discovered, or extra cleaning required, after departure, we will notify the Guest in writing within 7 days of departure, providing detail of the issues and an invoice for the cost of rectifying them. McBains will not be held responsible for any personal injury, loss or damage to personal effects howsoever arising at the unit or its grounds.
Indemnity and warranties
The Guest and the Organiser shall hold blameless and indemnify McBains, its teachers, facilitators, community, directors/members/owners, officers, employees, agents, independent contractors, representatives, subsidiaries, affiliates, controlling or holding companies, and insures past and present (“the indemnified parties”) who shall not be liable or responsible for any personal injury, harm, death, loss of support or any other damages of any nature whatsoever whether arising from negligence or any other cause whatsoever. McBains will not be held responsible for any reason whatsoever for the non-functioning of any equipment brought on to the premises by Guests, the Organiser or their group. McBains will under no circumstances be liable for the loss, damage and/or theft of any property of the Guests, the Organiser or their group.
Right of admission reserved
McBains, and the owners, at all times reserve the full right of admission and accept no liability for any loss or damage that may result from the legal and reasonable exercising of such rights.
Cancellation Policy (McBains)
McBains reserves the right to cancel any booking forthwith and without liability on its part in the event of any damage or destruction of the venue by fire or any other cause, any shortage of labour or food supplies, strikes, lockouts or industrial unrest, or any cause beyond our control which shall prevent McBains from performing its obligations in connection with any bookings.
Privacy
McBains shall take all reasonable steps to protect the personal information of Guests. Your personal information will not be sold to third parties.
Publicity
McBains reserves the right to photograph or film events or people staying at McBains for its own use.
Variation
McBains may, in its sole discretion, change this agreement or any part thereof at any time without providing notice thereof.
Additional indemnity and warranty
You hereby agree, as a condition of your occupation of the premises, that McBains and the owner, manager of the premises and their affiliates and respective directors, officers, employees, agents and representatives, shall not be responsible or liable for any accident or any injury or death of any person or the loss or destruction of or damage to any property, whether arising from fire, theft or another cause whatsoever and by whomsoever caused or arising from the negligence or wrongful acts or omissions and unconditionally indemnify and agree to hold harmless McBains in respect of an responsibility and/or liability as aforesaid.
